Jury: Dad Killed Baby Over Broken Xbox

PHILADELPHIA (AP) - A man who spent long hours each day playing video games was convicted Tuesday of killing his 17-month-old daughter when she pulled down his Xbox console.

Prosecutors believe Tyrone Spellman pummeled Alayiah Turman, cracking her skull several times, while her pregnant mother napped in another room in September 2006.

Jurors rejected arguments that Spellman confessed to protect the mother and convicted him of third-degree murder and child endangerment. He was acquitted of first-degree murder. He could be sentenced to about 23 to 47 years in prison.

Spellman fled the house after the beating, and the mother, Mia Turman, had no reason to go in the bedroom where the baby was found, prosecutors said.

"He (Spellman) spent six to seven hours a day in there playing Xbox," Assistant District Attorney James Berardinelli said.

Spellman, 27, of Philadelphia, confessed to police the next day, but defense lawyer Bobby Hoof noted that his statement came after 24 hours in custody.

"He's not happy with the verdict. He does not agree with the verdict, but he respects the jury verdict," Hoof said of Spellman.

An autopsy showed that Alayiah had suffered a broken arm about two weeks before she died - an injury that city social workers did not see on two visits to the house in late August, when they found the baby well.
The city took custody of the couple's second daughter, born after Alayiah's death.

You do understand that prosecutors make mistakes from time to time right? Trust me on this....I have been on both sides of this. Police also make mistakes and can become overzealous. My roommate from law school recently got a case dismissed where the police were overzealous. They refused to look at anyone else...just knew they had the right guy....they didn't.

Regardless of his guilt though I would sterilize him and his girlfriend. They have contributed nothing to society. Maybe we should give em the death penalty for that. We don't need culls reproducing. Harsh....yes.

I think the death penalty should be a mandatory sentence in murders of children where there is irrefutable evidence against someone, regardless of 1,2, or 3rd degree. My only problem with the bullet, or chair is that they're to quick for someone like this. Some lethal injection of slow acting snake venom would be more fitting, or maybe stoning.

This brings to mind a fitting and somewhat inhumane punishment. Give him the "Boxing Helena" treatment (okay, I know it's a sick movie, but sick actions should be subject to equally sick consequences). Hack off his arms and legs and leave him a torso. Put him in gen pop and let the inmates have fun with him. He'd be begging for death after a week. That is honestly the only punishment that would be fitting for this disturbing Ahole.
