Yea but he is still profiting off of the image of a current NCAA player in Clowney. It even mentions Clowneys name on the bottom of the framed picture.

He is certianly allowed to sell images of himself and make a money from it but he is also selling a image of a active NCAA player in Clowney as well which is against the rules.

Technically he could say that he's only profiting off his image, and that JC is simply in the picture... similar to Marcus making a run on a play and other guys just being in the picture (as they watch him score might I add). The likeness he's profiting off of is his own, not JC's. Just not in his best light.

I think the difference also is not selling it, as much as where does the money go once sold... if it went to JC, then it would be a violation... going to V. Smith... nope.

who the heck is going to want Smith's autograph on that picture? I can understand having both, but I would want Clowney to sign if I only had on signature. And I sure as hell wouldn't pay 60 bucks for Smith's autograph

No one can use a image of a current NCAA player in any type of merchandise and make money off of it period. It even says Clowneys name at the bottom. What he is doing is a clear NCAA violation.

OK... so first question... say it is... who will you penalize? Michigan? he no longer goes there, so a player isn't profiting. Jadevon Clowney? nope, he made no money and didn't sell it. Vincent Smith? He's done with his eligibility.

What's being discussed now is can the NCAA profit from Current or former players.

I think that whole who can profit on current players likeness thing is still being sorted out in court as to does the NCAA own their rights or not, and where it falls under. However many artists have pictures of drawing and things of players, both current and former. Its not a violation... the question is where legally it falls. Its a copyright question.
