Sara Jane Harris tweeted this out but then also said that it seemed that they were just witnesses not invovled

@SaraJaneHarris: Sounds like Hampton and Quarles had nothing to do with the incident at the NY club, just witnessed it.

Is TMZ the only outlet that has publicized this? If so, and if it turns out that Kelcy and Vic were only witnesses to the assault, would they be able to sue TMZ based upon defamation of character?

It gets plenty more complicated in terms of the public figure and limited public figure exceptions as well as what standards actually meet those elements and then what defenses may exist.

Regardless, no, they would not have a claim for defamation. The TMZ article did not make a false statement purporting to be fact. The report says that a "source" told them they were "wanted for questioning." That's true, so far as any of us know or will ever know due to TMZ's right to protect its source. The article does not say they actually committed the act in question. It is also likely that Vic and Kelcy would qualify at least as limited public figures subject to lesser protection from public statements about themselves.

Way too early to determine if this is true or not, but even if they were in a position as a witness in such circumstances does not look good for them, IMO, and it not a good reflection on the University and it's student athletes. I hope it's proven to be a false story, and that they were not witnesses, that would be what's best for both of those guys as they embark on their professional careers !!!

Quarles denies being there and says they have him mistaken for Chaz Sutton. Sutton also denies being there. Vic Hampton was called by The State and hung up on them.

I just read the report from the ny daily news site and they say they are just wanted for questioning as witnesses. The article also claims that Chaz Sutton was stabbed in the shoulder in an unrelated incident at the same club.

Oddly enough, I did not see a bandage on Chaz when I ran into him. And, Chaz has told the state paper that he didn't go out that night and did not go to the club. Quarles also says he did not go to the club.
