I think the difference also is not selling it, as much as where does the money go once sold... if it went to JC, then it would be a violation... going to V. Smith... nope.

No one can use a image of a current NCAA player in any type of merchandise and make money off of it period. It even says Clowneys name at the bottom. What he is doing is a clear NCAA violation.
