    NCAA Will Not Renew EA Sports Contract

    The NCAA has made the decision not to enter a new contract for the license of its name and logo for the EA Sports NCAA Football (NASDAQ: EA [FREE Stock Trend Analysis]) video game. The current contract expires in June 2014, but our timing is based on the need to provide EA notice for future planning. As a result, the NCAA Football 2014 video game will be the last to include the NCAA's name and logo. We are confident in our legal position regarding the use of our trademarks in video games. But given the current business climate and costs of litigation, we determined participating in this game is not in the best interests of the NCAA.
    The NCAA has never licensed the use of current student-athlete names, images or likenesses to EA. The NCAA has no involvement in licenses between EA and former student-athletes. Member colleges and universities license their own trademarks and other intellectual property for the video game. They will have to independently decide whether to continue those business arrangements in the future.

    The one year we have a player good enough to make the cover the contract doesn't get renewed. Chicken curse is still alive and well.

    of course i dont know the business ramifications or the legal positioning of ea and the schools going forward, but it sounds to me like it changes everything or virtually nothing. if the schools were licensing everything before, then basically its the ncaa saying our name is off the game, we cant be sued. then it becomes is ea and the individual schools and conferences fine with carrying that burden.

    sounds like it certainly kills off any last hope of a college basketball game returning.

    The law suit against the NCAA by former and current players pretty much forced them to do this. There will never be another college sports game again most likely.

    Actually not true. EA Sports doesn't need the NCAA for anything other than the NCAA logo/name. The individual schools/conferences license the logos/stadiums/mascots/etc. to EA Sports. My guess is they will continue to do so.

    The way the legal analyst explained it on Fox Sports radio just now framed it like this. If any game company want's to make another college sports game be it football, basketball, baseball etc they will have to pay each individual player royalties for use of their likeness even if they make the game in a way where none of the players look like current players. This will go against NCAA policy about paying players and thus none of the member institutions will ever sell their rights to use their universities logo for any game. The guy basically said that this is the end to any college sports game ever being made again.

    How are they going to pick it up? They will be subject to the same lawsuit and rules that EA was.

    I was just about to come post this ... and knew a bunch of you would go insane over this.

    It says that they individual teams have their deal with EA, so there will still be a football game. It will probably just be called EA SPORTS COLLEGE FOOTBALL 2015.

    It also says that it runs out next year, so EA will probably still do NCAA 2014, and it'd just end with that game.

    Nothing changing here, just won't have the NCAA banners/stickers/name anyway

    hopefully he doesnt know what he's talking about. at this point yeah im skeptical too about ea and the schools/conferences getting together and making a college football game without the ncaa having their back.
    certainly what the legal analyst said would be the case if the lawsuits dont go ea's way. its unlikely if ea gets scared and doesnt make a game next year that another company would try until theres a legal decision on the player likeness issue and compensation.

    Well the lawsuit is against the NCAA not EA sports. The lawsuit is not over and is still ongoing but todays decisions by EA pretty much is the writing on the wall that the NCAA is going to lose. If that is the case then I don't see how it would be possible for any company to make a college sports game ever again. They would have to compensate the current players for use of their likeness because of this lawsuit and that would go directly against NCAA rules. With that being the case no university is going to license out their logo to any game company with knowing that their players would be in violation of current NCAA rules. The only way I see any of this changing is if the NCAA itself changes its rules and allows current players to be compensated for use of their likeness.

    Damn....

    Right as EA Sports is releasing the IGNITE engine for sports games the NCAA goes and does this crap. Even if the schools license their own likeness for the game, it will never be the same. Realism will be gone, without the NCAA in it, it is not college football, its just some crappy game with our teams on it. I want realism, not fake crap. Jeez just pay the damn players so we can continue to play a video game that I have come to enjoy over the last 20 years.

    Contract ends in June 2014, so the game would have to be released by then but they said this year's is the last to be NCAA.

    No official word from EA about it yet but I wouldn't be surprised if they either stopped making the game or took at least a year off from it.

    And reading various articles no doubt about it NCAA has no interest in taking part in video games any time soon due to all of the lawsuits. Hopefully they'll start paying players sooner rather then later so I can enjoy NCAA video games again someday.

    This is just completely untrue. This lawsuit is far, far from over and there is no way anyone can at this point in time predict how the judge will rule. This is a matter of a cost / benefit analysis being performed by the NCAA. In the current market, is it in their best interest to continue with their licensing to EA and expose themselves to further litigation? They have concluded, for the time being, no. In other words, as we lawyers are wont to advise our clients to do, cover your ass. That doesn't mean you've given up and conceded defeat.

    Furthermore, your point about having to compensate the players directly would also be inaccurate since they are claiming they are not currently using any of these players likenesses.

    Your point about the University licensing out their own trademarks and likenesses to EA being in violation of NCAA rules (if I'm interpreting your comment correctly) would also be wrong. As the first post here clearly states, they already do that. The NCAA doesn't own the "University of South Carolina" name or any of its trademarks or the likenesses of its uniforms, stadiums or other intellectual property. They can license that out to whoever they see fit, just as they do with apparel manufacturers that sell jerseys and hats with USC names and logos on them.

    Finally, a lot of what the above-referenced Fox writer and also what you have said are premised on the notion that the NCAA is going to lose this lawsuit. We have to wait and see on that. I haven't even yet heard the ruling on the class certification question, and the case certainly hasn't reached any point in the proceedings where the substantive and factual issues of the case are being ruled on by judge.
