I don't know about NC, but in some states you don't have a choice about blowing. My child is suspended for a semester for underage drinking in Delaware. In that state you can't refuse the breathalyzer. (I would have said she couldn't refuse to blow, but I know what kind of comments that would have elicited, and this is my daughter I'm talking about!)

I love the fact that if you're 18, you can fight and die in a war, drive a tank, pay taxes, and be tried as an ADULT, but can't drink a single beer. Not making excuses for Tanner, he should have known better, but that might be one of the stupidest laws on the books.

I know someone who was pulled over for DUI in SC when they were 18 (in 2004). They refused to blow and their license was automatically suspended for 3 months (maybe 6? Can't remember), for refusing. Still beats the alternative if you can get an attorney and get the DUI dropped. Also, you can get an attorney and get a temporary license and be driving the next day.

I swear the alcohol related arrests this football team has is unreal. If not for that we would be clean.
Why do they have such a hard time being responsible about it? And I don't buy the excuse that he's a college student. I graduated from USC and knew plenty of people over there that never had ANY issues. |

Let me be clear, I do NOT condone getting behind the wheel of a car after you've been drinking. That's one thing I've been adamant about even since I was a teenager.
If I went out and drank, I stayed there.

Your driver's license is issued with "implied consent" to take a breathalyzer. That is why your license is automatically suspended when you refuse the test. You have the right to refuse a breathalyzer. The State will take your license under the implied consent authorization for its issuance.
You may also have the option of alternative testing, like a blood test. The breathalyzer test is notoriously inaccurate and can be off by quite a lot depending on the machine, the operator, and other factors.

The worst case scenario with this is most likely to do an alcohol education program like we have in SC and it will be expunged from his record. A shame the media has made it sound like he was pulled over and charged with DUI. Most people are literally more "impaired" on their drive into/from work due to a lack of sleep, distractions, etc than this kid was.
