I don't know about NC, but in some states you don't have a choice about blowing. My child is suspended for a semester for underage drinking in Delaware. In that state you can't refuse the breathalyzer. So your daughter HAD to blow?

I would imagine that for a state to have that law, there has to be something in there about probable cause. Did the police report say why the officer suspected her of drinking?

I love the fact that if you're 18, you can fight and die in a war, drive a tank, pay taxes, and be tried as an ADULT, but can't drink a single beer.

Not making excuses for Tanner, he should have known better, but that might be one of the stupidest laws on the books.

I don't know of any state that "forces" you to blow without a full blown search warrant (which virtually no judge will give you ) as this would violate your constitutional right. I know in most states though if you are pulled over for DUI it is automatic suspension of your license (basically they treat it as you pleading guilty on the site) but you can fight it in court. From a legal standpoint most lawyers will tell you not to take a field sobriety test no matter how sober you think you are (many of these tests are virtually impossible to stone cold sober people for the most part) and not to blow. In South Carolina you can deny a field breathalyzer with absolutely no penalty. This is one of the ways many people who don't blow get off. They get harassed and basically told that they have to take this breathalyzer or their license is suspended (first procedural error). Then they will most likely make a few other mistakes and try to over aggressively coerce you into blowing back at the station. Everyone should have a lawyer that they know of to call as you do have the right for your attorney. If they deny you that right before they try to force you to blow that is another way many people get out of the charge. The problem is that if you consent to the breathalyzer and they don't make any huge errors then the charge is probably going to stick because your consent nullifies their previous errors.

But back to the point, I don't know if in any state forces you to take it. Also, in many states if you get pulled over in one state you never lose your home state driving privileged due to a lack of reciprocity.

You are so right. I've always thought it was ridiculous to raise the drinking age to 21. I can't believe that law is still in affect.

But, under no circumstances should anyone drink and drive. Alcohol affects everone differently. Just don't drive a vehicle after consuming alcohol.

I know someone who was pulled over for DUI in SC when they were 18 (in 2004). They refused to blow and their license was automatically suspended for 3 months (maybe 6? Can't remember), for refusing. Still beats the alternative if you can get an attorney and get the DUI dropped. Also, you can get an attorney and get a temporary license and be driving the next day.

It is 6 months now...might have been 3 then but not sure. Sometimes when you get out I think you can ask the judge then for a temporary license and he will grant it. DUI's are hard to convict without that concrete evidence which is why a lot of times those that can afford the 2-5k for the lawyer never even see the inside of the courtroom. Even if you do it will be stretched out for so long a lot of times they just plead it down. Unless you wreck or hurt someone they really don't care about the charge...they just want to do some fundraising..getting pulled over (charged or not) for DUI will scare most people out of ever doing it again or even driving when questionable but the people who are going to disregard and end up on a moped without a license for the rest of their lives would drive drunk every single day even if they got caught every day.

Why do they have such a hard time being responsible about it? And I don't buy the excuse that he's a college student. I graduated from USC and knew plenty of people over there that never had ANY issues.

Let me be clear, I do NOT condone getting behind the wheel of a car after you've been drinking. That's one thing I've been adamant about even since I was a teenager.

Your driver's license is issued with "implied consent" to take a breathalyzer. That is why your license is automatically suspended when you refuse the test. You have the right to refuse a breathalyzer. The State will take your license under the implied consent authorization for its issuance.

You may also have the option of alternative testing, like a blood test. The breathalyzer test is notoriously inaccurate and can be off by quite a lot depending on the machine, the operator, and other factors.

The worst case scenario with this is most likely to do an alcohol education program like we have in SC and it will be expunged from his record. A shame the media has made it sound like he was pulled over and charged with DUI. Most people are literally more "impaired" on their drive into/from work due to a lack of sleep, distractions, etc than this kid was.

seriously, there were times after working 7pm-8am where I knew I shouldn't have been on the road, definitely worse than driving after 3 beers
